Mediations and Arbitrations are considered booked and scheduled when a Confirmation Letter is e-mailed.
RATES:For a half-day mediation, a minimum fee of 3 hours will be billed for the conference, in addition to preparation time. For full-day mediations, a minimum fee of 6 hours for the conference, in addition to preparation time, will be charged. There is no "preparation time" charge for review of up to twenty pages of materials.
TRAVEL$400.00 per party for round-trip travel of more than 120 miles from Tampa.
The mediator is entitled to compensation for all time spent on the matter, including but not limited to preparation time, telephone conferences, mediation attendance and collection efforts (to include but not be limited to attorneys’ fees and costs).
Once your mediation and/or arbitration is scheduled, Stewart Mediations will decline other engagements requested for the same date and time as your mediation and/or arbitration. Accordingly, the following policies apply to all matters:
Stewart Mediations must receive email notice of cancellations at least 5 business days before the scheduled mediation and/or arbitration date. In that event no cancellation fee will be charged. Without timely notice, there will be a three (3) hour minimum mediation cancellation charge to be divided and paid pro rata for a half-day mediation and a six (6) hour minimum charge to be divided and paid pro rata for a full-day mediation. The fee for cancellation of abitration will be the greater of three hours or the hourly rate for arbitration preparation prior to the arbitrator's receipt of written notice of cancellation.
Unless the parties agree in writing, on who should pay the cancellation fee, each party is responsible for his/her/their share of the cancellation fee, regardless of who may be responsioble for the cancellation. In the event of a dispute as to who is responsible for the cancellation fee, each attorney, after making payment, has the right, subject to all applicable rtules and direction of the Court, to file an appropriate motion with the court to seek reimbursement from other parties.
Cancellation fees apply regardless of whether the mediation is cancelled or rescheduled. Cancellation fees will NOT apply if we are able to schedule another mediation in the time period reserved for your mediation.
